I'm not sure of all the details, either, but it sounds a lot like the case
of a Canadian (employed under identical circumstances) who was then
tranferred to the US parent company and (this is where I'm a little fuzzy)
the parent company was trading with Cuba through the Canadian subsidiary. 
I thiink he was 'responsible' for this activity and he and the company were
both charged under the 'Trading with the enemy act'.  But....he was also
charged - and convicted - for stuff related to his activities in Canada
while working for the Canadian subsidiary.
