It is illegal to listen, or it isn't illegal to listen, depending on
who'se interpretation you listen to.  I think we all agree that is
definately illegal to use any information heard there.

Correct.  In fact, a lot of drug busts have occured because the dealiers
were using their wireless phones to arrange deals... while the cops were
sitting down the block, listening and taping... without benefit of a
court wiretap order!  I would think that a good lawyer could get that
thrown out of court in a New York minute, but I've heard that the
convictions were made and they were not overturned.
