Well, the software knows the port speed is 38400 instead of 57600, so the
calculations MAY change.

One test is not conclusive. If you had tried it 10 times, and all were
failures, then I'd say we have a consistent problem with V42 connects at
low speeds (where low speed hasn't even been determined yet).

So? When have I suggested otherwise? And BTW, I'm not trying to solve the
failure to connect with EC x% of the time, I'm just after the timeouts to
