You have the automatic right to a trademark in the same way that you
have the automatic rigth to copyright. A registered trademark gives you
more control, but costs about $1,000 to set up and a yearly renewal.

If you want to sell your program overseas, you should secure American
copyright, which has to be applied for. Most other countries run along
similar lines to Australia. The Australian government will assist in
fighting for compesantion in cases where your copyright is infringed
overseas.
