Hi Rich:
 
According to a copy of the Listener's Lawbook (1991 edition)
mobile scanning is pretty much illegal in Kentucky.  I
believe it is also illegal in Tennesee.  As for Ohio, there
are no entries in the lawbook for it.
 
I can understand your wife's concern about legally being able
to listen with a scanner.  There's no sense in hacking off
the DOT boys at the weight station.
