Using that logic, every Barbecue place in town is guilty of outrageous
conduct. They serve ribs with the bone in. If you swallowed the whole
bone along with the meat, you'd surely have some adverse reactions
because of your stupidity... not because they served you something that
could and did cause injury.
This "victim" was victimized by their own actions, not McD's. Coffee is
HOT by design. Anyone who uses undue caution in handling a properly
prepared cup of it is guilty of misconduct on their own behalf.
If we curtail all transactions between merchants and their customers
when said transactions include some product or service that CAN cause
injury when improperly used, our market system will collapse.
Perhaps all cell phone manufacturers should be held liable for the
injuries and deaths that occur due to dialing the phone while driving.
Actually, they are MORE liable because their product is being used
according to its design while the McD's coffee wasn't.
