I tend to agree. The old fellow is probably not a criminal type, just a
tired old gent who is frustrated with punks tormenting him. What he
needs is a simple wake-up call to let him know that he can't just grab
the first kid that comes along and beat the daylights outa him...
He should, however, be liable civilly for any physical and/or emotional
damages that he may have caused to the kid and his family.
