Supreme Court Justice Stephen Breyer did a Q & A session with
teenagers on C-SPAN about a month ago. One of them asked him a
question that I think was related to yours -- maybe something about
whether the feds had standing to outlaw marijuana. The question was
more specific than I understood, but Breyer seemed to know exactly
what he meant. Breyer said ~No, that's never been tested, it's never
come up.~ I don't think it would be as simple as that makes it sound
-- ask Carl Olsen or somebody else who has REALLY TRIED to fight it
out in court.
