The issue with Rusy and Edie's was with copyright violation (piracy), not
underage users/downloaders/viers. Today, that's still the biggest issue. If
you're gonna put (or allow the upload of) adult material, you gotta make sure
it's copyright-free so Playboy (or whoever) doesn't come after you.
Of course, that threat level is pretty low if you're just talking about a
dial-up or Telnet BBS. I doubt very much adult content copyright holders are
dialing or telnetting to BBSes much these days. But if you make those files
availble for download via anonymous HTTP or FTP, then it's likely you'd raise
a red flag eventually.
