The parents can request it, yes, but a panel put together by the
school does have the authority to deny this request. The panel
includes the teacher, special education coordinator, etc. If this
panel decides that the testing is really not needed, then they can
legally deny the parent's request. If a teacher suggests testing
needs to be done, it is the responsibility of the school to provide
this testing.
A school does have a mechanism to deny frivolous requests by parents.
A couple of years back here locally the requests by parents took off
like a wild fire because word got out that ADHD kids are (in some
cases) eligible for a SSI check.
