Legal challenge to D.E.A.'s
scheduling of marijuana
The U.S. Drug Enforcement Administration (D.E.A.) restricts marijuana
plants more severely than coca plants or opium poppies.
In 1970, Congress placed marijuana in the most restrictive category of the
federal Controlled Substances Act, a category for substances with no known
medical value.
In 1986, the D.E.A. admitted that the principle psychoactive substance in
marijuana (THC) has medical value, but has refused to move marijuana into
the less restrictive medicinal category in which coca plants and opium
poppies are found.
On Tuesday, December 31, 1996, a petition for certiorari will be filed in
the United States Supreme Court challenging the D.E.A.s irrational
treatment of marijuana. The full text of the petition can be found on the
