No but they might be guilty of war crimes. An intelligence agent (or
agency) might be though.

Problem is that you President is inviting in such a consideration e.g. with
their illegal combatant crap.

e.g. most special forces do without std uniforms & signs recognisable
from a distance thus are illegal combatants & thus can be considered
terrorists. Ditto snipers.
