I wasn't aware of that, BTW When i said Spirit i was refering to the
Thunder not the 'II'

I have used my old Series 3 E7 conecting with the above mentioned
Thunder without problem, sometimes only at 12k or 9k6 but i've always
put this down to bad qty lines.

If there is no tone difference how does a ter capable modem tell if
there is the same at the other end.

I can only comment on my own experience with the Courier, i have v32ter
enabled and what v.32bis connects i've had  hasn't displayed
the symptoms you've discribed above.
