What's to prove?
The evidence is openly available at most libraries (get a copy of the
"Constitution Act(1982)" and, optionally, a copy of the BNA
Act(1867)(which is included with the new(1982) document in one book at
the Vancouver Public Library)
Section 92(2) states: "Direct taxation is the EXCLUSIVE domain of the
Provincial & Civic Legislatures"(emphasis mine)
The Supreme Court library has a Folio CD containing every Supreme Court
decision in Canadian history -- I searched for cases involving
Constitutional challenges to federal income tax and found about 6-10,
all of which were denied on the basis of Section 93(1), which was cited
as, "the federal parliament is allowed to generate revenues in any way
it wants." (BUT what was omitted in the Supreme Court decision was the
second half of 93(1) (which I looked up in the aforementioned book)
which continues: "...as long as it doesn't contravene any other section
of this Act." (funny. . . 92(2) was in the same Constitutional Act the
last I checked (& even rechecked!)) :P
So the evidence is plain -- they just don't care and aren't going to
change something that generates so many hundredds of millions which
leave plenty of room for skimming/etc. . . :P
