You may "beg to differ" all you like. K56 Flex comes in two versions, client
and server (host). The client (what your friend has) connects to a normal
POTS analogue line and can receive at up to 56K - when connected to a K56
Flex server. The K56 Flex server _must_ connect to the telco with a digital
connection, and can _download_ at up to 56 K.
You might consider how it is possible for your 14.4 kbps modem to upload at a
faster speed than 14.4, no matter what is on the other end of the line.
The answer, of course, is data compression. The rest of the answer is the
fact that your comm program can't calculate upload speeds with any accuracy
because of the effects of the buffer in the modem, and that's why you see
excessively high upload speeds.
