You're missing something. The modem now K56 Flex now - a proprietary
protocol. The "upgrade" referred to is the upgrade to the ITU standard,
which will most likely _not_ be either K56 Flex nor X2 - but something else.
Hayes (and other manufacturers) have stated that upgrade will be free, as you
say.
There are ISPs currently running K56 Flex host modems that offer connect
speeds up to 56k.
