I must admit (and IANAL) that I can see the logic in Gonzales argument.
You've just come through a war of Independence and you want to allow for
habeus ... but not just yet.  So you structure your constitution so that
habeus isn't in effect now but if/when laws are passed that enshrine habeus
then those laws cannot be revoked.
