That may be Activision's whole point to the lawsuit.

First, Enterprise doesn't -bill- itself as being Star Trek.  Yes, fandom
knows that Enterprise is Star Trek, but Activision seems to be saying that
Paramount is allowing the name "Star Trek" to fall into disuse.

Second, Activision seems to be saying that Star Trek's name doesn't sell itself.

The video game industry is the largest entertainment industry in the
-world-; video games took in more money last year than the entire film
industry.  Grand Theft Auto Vice City earned more money in one day than
Attack of the Clones earned in its five-day opening weekend.  The Two
Towers and Enter the Matrix/Matrix Reloaded show the potential for synergy
between the film and video game industries, yet Paramount seems wholly
oblivious to that.  A Star Trek Nemesis game, released at the same time as
the film, could be been a blockbuster for Activision, yet Paramount
wouldn't allow them to produce such a game for simultaneous release with
the film.

The only result I see from this lawsuit is that a judge invalidates the
licensing agreement between Activision and Paramount, with money changing
hands.
