That might be a toughie.  It would seem the prosecution would have a 
planeload 
full of witnesses....surely someone would have the time and willingness to
testify.  If I'd been on the plane, there would have been no need for a 
trial. 
Of course, it's easy to be rugged when behind the keyboard.  :)
