I think I didn't read this thread entirely but if this is caused by a Telnet 
user, then try switching Telnet servers.

I would recommend Zoob Telnet Server, freeware, and NetFoss from PC-Micro.

NetFoss does something in the way it virtualises the COM port for the DOS 
session. Also, the BBS itself runs as a "shell" process in NetFoss and its 
worth giving it a try.
