That an act enjoys legality makes it something that is not criminal by
statute, and not punishable under the laws of the state.  However,
legality under statute does not lessen the fact of criminality, whether
it be so according to God's law, which adultery is, or whether it be so
in terms of decency and/or impact on society.  For example, slavery,
particularly as practiced in this country (indentured servitude was
called slavery, but is a whole different thing), was always criminal,
despite its legality under the Constitution, and today is criminal by
statute.  Abortion is criminal as well, despite all pronouncements to
the contrary by this country's courts, and was criminal by statute for a
very long time.  As noted in my previous message to John, adultery
follows murder and precedes stealing in the Ten Commandments, and in
some societies, it is still punishable by death.  It is an act that is
harmful to the people as a whole, to the society in which they live, and
therefore is a crime against the people.
