I've been reading some of his writings, and I don't think he comes close to
Scalia. In one dissent (I don't have the cite offhand, but it regards due
process), he is all over the place. On one hand, he regards due process as
necessary (what a relief) in theory, but then regards it as unnecessary in
most circumstances (huh?).
This guy is bad. Those who want an activist judge will get one in Alito.
