Subject: N.Y. Court invites Plaintiffs to move to have management
held IN CONTEMPT
Date sent: Thu, 5 Mar 1998 12:35:59 -0500
TO ALL N.R.A. MEMBERS
INTERESTED IN A FAIR ELECTION --
This morning the Hon. Judge Beatrice Shainswit held a
hearing in open court concerning publication in the March
issue of the Rifleman, Hunter, and Guardian of the full
page "NOTICE" which included the full caption of the
suit for injunctive relief (listing the names of all ten plaintiffs)
and the statement:
"Ten candidates for the NRA Board of Directors filed a lawsuit in
the Supreme Court of New York. They filed to prohibit printing
in the Official Journal the Nominating Committee Report and any
mention as to how any candidate was nominated in the biographical
sketches or political ads. A preliminary injunction was issued
by Justice Shainswit of the Supreme Court. This injunction is
being reviewed on appeal by the appellate division of the Supreme
Court. Until it is reversed, the injunction must be obeyed."
This is the notice which appeared at page "P" of the ballot insert.
A copy of this notice was sent to the judge by a third party. Earlier
this week the judge's clerk informed counsel for the plaintiffs and
defendants she wanted to see them.
During the hearing which took place this morning the Judge:
-- Described N.R.A. as an organization "out of control".
-- Handed management its head for publishing the "Notice"
effectively blackballing the ten plaintiffs.
-- Invited the plaintiffs to file a motion to hold the N.R.A.
IN CONTEMPT.
Steve Shulman (N.R.A. management's counsel) left court
BEET RED & CURSING.
Will keep all posted as things develop further.
Yours for the 2nd Amendment... (and a fair election)
