I again disagree. The FCC says only they have jurisdiction over amateur
gear. I believe that the specific document in which they claim federal
preemption over state and local laws is PRB-3. It only applies to ham
transceivers with out-of-band scanning built into it. The locals cannot
legally sieze licensed amatuer equipment with incidental scanning features.
Even so, If I were pulled over for a traffic offense of some sort in a
state with a scanner law, I would either turn off the radio or switch
to a repeater frequency as soon as I saw the nice pulsing lights behind
me, and if asked, I'd say it was a two-way radio.
"Here, see the microphone and the push-to-talk button? I can try to reach
someone on the radio if you like." "Yes sir, this is an FCC licensed two-way
radio. Would you like to see my license? I carry it in my wallet."
You stress "two-way radio," "FCC license" and stress it over and over; but
ONLY if the cop questions the presence of the radio. If he doesn't say
anything, don't bring it up!
