I strongly disagree. One of the reasons why the FCC declared preemption
over state scanner laws was that hams were getting their legally-licensed
equipment confinscated by locals. The FCC said the locals can not do that.

That's unConstitutional. It would be considered an "ex-post-facto" law,
which is forbidden in the Constitution.
