It's local. In my area, for example, there are no state or county statutes
about having scanners in vehicles, but a couple of cities do not allow the
operation of a scanner in a vehicle. This is not often enforced, and might
only come up if you're stopped for some other reason. In Chattanooga the
city council voted down a law that would have allowed cops to stop people
just to check for seatbelt violations, so you can understand that cops aren't
going to go around stopping people just because of an extra antenna.
Some people tell me that laws against having scanners in vehicles are common
in the US, others tell me that they're very uncommon but have a lot of vocal
opponents who exaggerate. Ads for radar detectors say that they can't ship
to a list of 3 or 4 states where they aren't legal, but some people carry on
like half the states in the union have outlawed them, so I don't really know.
