In simple terms, YES! The exclusion in most states says radios that
tune to EXCLUSIVELY frequencies allocated to amateur operators.
 
BTW.. there are at least 2 more bills in congress to even further toughen up 
the communications privacy act. Both would instantly de-certify any
radio able to tune to any frequency outside of specifically designated 
amateur radio bands. Chew on that one.
