That would depend on the way the Particular law is Written. you could
have the Ham Transceiver with you that "Incidentlly" received other out
of band frequencies. but at the same time Local Law could FORBID you
from Listening to the Police Frequencies while in your Car!

That is NOT covered at all and in those States where they are Forbidden
in a car they can be confiscated no matter what Licence you Hold.
Remember the HAM licence ONLY authorizes you to Use the HAM assigned
Frequencies and NO OTHER! Under the Constitutional Provision of States
Rights the individual States CAN and Have placed Restrictions on
reception of Public Service Frequencies while in a Car. Of course NON
of these Restrictions apply in your Own Home, At least fro now. The
CELL privacy LAW is very scary and there is a movement in Congress to
FORBID the reception of ANY public Service frequency. It will be
Enforced by Forbidding Totally the Sale of radios that have that
capability.
