Well I don't know the law in your state, but the New York Vehicle and
Traffic law section (397) on scanners says, "Nothing in this section
contained shall be construed to apply to any person who holds a valid
amateur radio operator's license issued by the federal communications
commission and who operates a duly licensed portable mobile transmitter
and in connection therewith a receiver or receiving set on frequencies
exclusively allocated by the federal communications commission to duly
licensed radio amateurs."
No need to reason with a small town "Harry Handcuffs," about any federal
pre-emption. Its right in the State V&T code.
In my community (and many others) hams are also exempt from (or less
restricted by) local antenna rules. I have a neighbor who's VERY upset
by all of the antennas on my roof, my garage and my multiple
satellite dishes. He complained to the town. When the inspector came
by, he saw the ham plates on my car and told the neighbor, he couldn't
do anything about it, because the local law exempts hams. Wait till my
tower goes up. :-)
