Some states exempt hams from scanner laws and some states do not. There
are a number of cases wherein hams have had their radios confinscated by
police. The FCC has issued a federal pre-emption notice regarding
scanner laws and hams, but this exemption applies ONLY to ham radios that
may be used as scanners, not scanners themselves.
I became a ham because I have always been fascinated with radio. It amazes
me that we can take pieces of metal and glass and quartz and generate a
signal that someone on the other side of the world can listen to. I like
looking at radios with lots of meters and knobs and lights and I like
playing with them. I've been a ham for 10 years and I still can't get
over the wonderment of it all.
