The modem _should_ fallback, and will if the right conditions occur. That's
not to say it will fall back in all cases, though. It's normally triggered
by some number of block errors in some time period. So, if you were getting
trigger-1 BLERS in the time period, the modem would _not_ fallback.

The 16450 (and even the 8250) UART can easily handle speeds in excess of
46kbps. The UART cannot be the problem here, because there's nothing in the
UART that can stop the flow of data - it has no "flow control" capability.
The UART could be defective, but I'd expect that would result in the modem
dropping the connection rather than the pause you're experiencing.
Try disabling V.42 and V.42bis - use MNP instead and see if there's an
improvement. You also might like to check the web for a utility that
configures your MTU - there's one called MAXMTU, I believe. A mismatch in
MTU can cause problems similar to what you're seeing.
