No, the reason why he didn't go for it in the first place was because he felt
he had a great case. That was before at least one surprise witness and
before 80-90% of his defense was thrown out by the judge. At that point it
became too much of a risk to go on.

everyone under similar circumstances gets probation.

Hardly. The judge is bound the by the law, and the law sets the MAXIMUM
penalty at 12 months in county jail and a $2500 fine. And there's virtually
no chance that he'll give Marv the maximum, given his spotless record.
